On
February 23, 2006, Adams, Cassidy & Phillippi filed a lawsuit
representing approximately 150 Plaintiffs who are former loan officers
for HomeBanc for claims against their former employer for recovery of
unpaid overtime benefits under the Fair Labor Standards Act of 1938
(FLSA), 29 U.S.C. §§ 201 et seq. In addition to HomeBanc, Plaintiffs named Patrick S. Flood as an individual defendant as an employer. Mr. Flood was the Chief Executive Officer and Chairman of the Board of Directors for HomeBanc. The case, a collective action under the FLSA, is entitled Bradford T. King v. HomeBanc Mortgage Company, Case No. 2:06-CV-96-FtM-99SPC filed in the United States District Court Middle District of Florida.
In
connection with that litigation, Adams, Cassidy & Phillippi
obtained summary judgment in a related case against HomeBanc, in a suit
that has since settled.
